Letter Before Action (UK)

The essential first step in UK small claims. Give the other party one final chance to settle before you take legal action.

What is a Letter Before Action?

A Letter Before Action (LBA) is a formal demand letter sent before starting court proceedings. It's your final attempt to settle a dispute without legal action.

In the UK, you're generally required to send a Letter Before Action before filing a small claim. The letter must clearly state:

  • What the dispute is about
  • How much money you're claiming
  • A deadline for response (typically 14 days)
  • What will happen if they don't respond (court action)

When Should You Send an LBA?

Common Questions

Do I legally need to send an LBA before going to court?

Yes, in most cases. The Civil Procedure Rules require you to follow a pre-action protocol, which includes sending a Letter Before Action. Failure to do so may result in the court penalizing you with costs, even if you win your case.

How long should I give them to respond?

The standard is 14 days for simple debt claims, but you can give up to 30 days for more complex disputes. We recommend 14 days for most small claims.

What happens if they ignore the letter?

If they don't respond within your deadline, you can proceed to file a claim with the court. The Letter Before Action shows the court you tried to resolve the matter reasonably.

Can I send it by email?

Yes, but it's recommended to also send it by tracked post (recorded delivery) so you have proof they received it. Our automated service sends it both ways.

What Happens After You Send a Letter Before Action?

If your Letter Before Action resolves the dispute, you're done. If not, here's what to do next.
